the fiscal cliff, the next big battle has already arrived. treasury secretary tim geithner says government borrowing hits the debt ceiling today. with me now, former new hampshire republican senator judd gregg. he's currently co-chairman of the campaign to fix the debt. senator, let's -- i want to start 50,000 feet, and we'll move down closer to ground level, but as a former member of the senate, we've now had two grand bargains, one around the debt ceiling, one around the fiscal cliff, seemingly, well, on the debt ceiling definitely, and on this one, seemingly fall apart. now that you're on the outside, are people right to be skeptical that congress can do anything? i hesitate to say big. even medium in terms of addressing our debt and spending problems? >> oh, they're absolutely correct in being skeptical, but congress can act. it has acted in the past. regrettably, it usually acts in crisis. for example, during the financial meltdown, when the entire banking system of our nation would have collapsed, congress did act. and we've acted in other situations such as right after 9/11. so, may

the fiscal cliff. with only three days to go, our next guest says it's not falling over the cliff we should be worried about, it's how much the landing is going to hurt. brian mcginnis is the head of the campaign to fix the debt, president of the committee for responsible budget and joins us this morning from washington. maya, good morning. what do you mean by that? what are you trying to say when you talk about the landing hurting the most? >> well, the point is that the fiscal cliff is a deadline and it's an important deadline that's there to help us focus on getting a big debt deal. the sad state of play is that it appears they're not going to be successful in that. they're not going to be able to replace the cliff with a big, comprehensive debt deal that's big enough to help fix the fiscal challenges of the country. but what's even additionally troubling now is that we may actually go over the cliff. and the fact that we are going to, because of partisan fighting, and an unwillingness to tackle these challenges, do something that is really going to harm the economy and harm all of us. i

this deal may not happen next. obviously a lot of attention tonight on the fiscal cliff. we're inside 30 hours until the expiration date on tax cuts. there are other important bits of business on capitol hill before the end of the year. in other words, in the next 30 hours or so. on friday, the senate approved a more than $60 billion bill to pay for construction costs for superstorm sandy. you see the video of that here. the house still needs to vote on that legislation. it isn't clear yet what the house is going to do. molly henneberg is live in d.c. there's a holdup in the house. what is it? >> the price tag. house republicans say it's too steep. a south carolina republican congressman said he and others want to help the people hurt by sandy but lawmakers need to figure out where the money's going to come from. >> it's not paid for. i know that's a difficult conversation to have but it's a necessary conversation. if we can't come together and figure out a way to stop spending someplace else to pay for this disaster, do we hope to be able to balance our budget and fix our spending diffi

the fiscal cliff. though some people would say, maybe we get a deal done in the next couple of days. i find it ridiculous that that would be the case. maybe they watch something through, i don't know. going into 2013, what do you think about the economy, what the backdrop for stocks? >> you know, you set it, maria, a lot hinges on the fiscal cliff. and certainly, yes. if you go off the proverbial cliff, taxes going uch and we're already, you know, coming out of a, you know, a slower than normal recovery. so i would expect expectations for the economy to come down. i would expect earnings expectations to come down. but i think if you're a stock investor, yes, there could be a knee-jerk sell off in response to all this. but as a stock investor, i think the key to 2013 then is those lowered expectations for the economy, for earnings, could then set up future positive surprises. i mean, really, even before this fiscal cliff, some of the economic reports coming out most recently, gdp, have been better than expected. i think that is a ps as we enter 2013. yes, there is going to be worries if we f

spending cuts, what they have set up is a series of mini fiscal cliffs, if you will, kate. so every three to six weeks, over the next six months, we could be going through nights like this where we're up against the clock and congress has to act and the president -- they have to figure out how to compromise or watch automatic headaches kick in. >> chuck todd is going -- it's going to be a long night. thanks for being with us on wall street today, this final trading day of the year. investors were hopeful of a deal would be work out by the time the closing bell rang at 4:00. stocks soared to their highest point today. the dow finished 166 points up, the nasdaq 59 points and the s&p 500 was up almost 2400 points on the day. for the year, the dow finished with a 7% gain. the nasdaq was up almost 16% this year and the s&p 500 gained more than 13%, a very strong year for stocks. so let's bring in cnbc's senior economics reporter steve liesman. steve, we just said the market was way up today, they thought we would have a deal. now we're headed over the cliff. this can't be good news for our eco

the fiscal cliff and what's going to happen over the next couple of days. gold is on track for its fifth straight weekly decline, but for the year it's the 12th year of gains. so this is the first year since 2004 that we've seen gold under perform stocks. one of the big winners came under a lot of selling pressure as a lot of people try to get ahead of the fiscal cliff. silver on track its fifth weekly straight decline. copper back-to-back gains this week. a little bit of hope that we'll see more demand for copper this year as china's new government may do some more urbanization. if you take a look at the metals, those with industrial properties, particularly the precious metals, platinum a big winner, palladium a big winner, those used in catalytic converters. >>> thank you, bertha. >>> the iranian navy holding massive drills in the strait of hormuz. this comes from iranian state television. the exercises include fire ships, warships and hover craft as well. we don't see a lot of reaction from the oil markets. wti is below 13 cents. that's a premium that we've seen for now, gosh, nearly

in connecticut, sandy, fiscal cliff, everything. with that in mind where do you see consumer spending, consumer discretionary spending next year? >> i think in 2013 there's always a place that excels in consumer discretionary and it's based on product, price and where they can expand in terms of channel extension. in 2013 i think we'll see names like nordstrom where they are accelerating the rate of growth. i think we'll see urban outfitters continue their turnaround, perhaps in an accelerated pace in 2013, and i think you're going to continue to see, particularly in the first half of the year, the demand for products from michael kors do well. second half of the year is a different story and perhaps the turnaround of tiffany's to be the name for the second half. >> meantime, r.j., i think you would agree retail remembers scrambling right now because consumer confidence is plunging. three reports in a row that have been pretty dismal. >> yeah, i would agree. i think we're looking for a bit of a pullback in 2013, not only due to the fiscal cliff issues that will become more aware, especially whe

$250,000. >> you're right. we're talking about three things when we talk about the fiscal cliff. one is the bush tax cuts of 2001 and 2003 that the democrats claim they want to protect for most americans. they all voted against them. they didn't want them in the first place, but now they recognize how terribly important they are, they claim. for two full years, all of 2009 and all of 2010, obama was president. you had a super majority of democrats in the house and the senate. they could have passed making permanent those tax cuts for l all, some americans, people making less than $250,000 a year, they could have done that. they didn't. why do you believe the democrats really want to do something they no longer have the votes to do when they could have done it when they had the votes. that's one part of the fiscal cliff. the other part is the sequester, which saves money. the president wants to end that. and the third part is $1 trillion in obama's taxes. that's the obama care taxes they hid from you because they're all scheduled to come in after he got safely elected. >> let's go b
